Dr. West Bites Back

When we last visited, I was astonished by the chutzpah of Dr. Stephen Hayne and Dr. Michael West, the Fabulous Forensic Fabricators who videotaped autopsies that, according to recognized experts in the field, committed "forensic fraud" by, among other things, pressing a defendant's bite mold into a deceased child's chin so as to make "bite marks."

Now Dr. West has surpassed himself. Dr. West gave a whining screed of an interview with the Clarion-Ledger's Jerry Mitchell published here:

Give the poor guy a shoulder to cry on, and who knows what you might learn:

I've exonerated three or four times as many people as I've convicted," he said. "I'm a little old dentist from Hattiesburg, and I've got the top lawyers in the country coming after me. The New York Times wrote an editorial on me. Why? They can't stand the evidence."

Yep, that's it. The Gray Lady bothered to write an article about a Hattiesburg dentist because they "couldn't stand the evidence." I'm sure the editors in Manhattan spend all day worrying about Mississippi defendants.

But in any event, which exonerations would you be talking about, Dr. West? Not Kennedy Brewer and Levon Brooks. After spending more than 15 years each in prison for crimes that they didn't commit, Mr. Brewer and Mr. Brooks were set free in hearings. The District Attorney personally apologized to them.

But Dr. West not only didn't exonerate them -- he still thinks they were involved in the crimes! Jerry Mitchell reports:

In each case, West testified he found those men's bite marks on the victims.

More than a year ago, DNA identified the real culprit, who told authorities he strangled, sexually assaulted and killed two, 3-year-old girls. He said he never bit them.

West - who said he hasn't practiced forensic dentistry in three years - stands by his testimony he gave in those trials, saying the two men must have bitten the girls before they were killed.

Oh, well. I guess we'll find those exonerated prisoners some other time. Or maybe we need to use Dr. West's famous blue light to find them. You know, the one he uses to see evidence nobody else can see. (Yes, he really says that).

But the most interesting thing about the West interview is that he revealed this stunning secret:

He said, "I'm personally opposed to the death penalty."

Shut my mouth. All this time the Periodontal Prevaricator has been sending prisoners to death row for crimes they didn't commit, he was really against capital punishment deep in his heart.

What's next? Dick Cheney is "personally opposed" to gun control? Rush Limbaugh is "personally opposed" to prescription drug abuse?

In the world where Michael West's blue light shines, anything is possible.

Quacks With Bite: Forensic Fabrications Exposed

While we're waiting for the verdict in United States v. Melton, please pause for a bit and consider another possible criminal violation of the civil rights of Mississippians. A little more than a year ago, Reason magazine's Radley Balko published his devastating expose of pathologist Stephen Hayne and forensic dentist Michael West, who practiced misanthropy as State experts in Mississippi criminal cases.

Then in Spring 2008, the exonerations of Kennedy Brewer and Levon Brooks demonstrated the human cost of false forensic testimony -- two men sent to Parchman's death row for over a decade (although one was resentenced to life due to mental retardation). When they were finally released, District Attorney Ben Creekmore, appointed special prosecutor in the cases, apologized for the wrongful incarceration on behalf of the State.

Now Mr. Balko has dropped another bomb. In the attached article, he posts a video tape of an autopsy at which Dr. West is seen pressing a defendant's dental mold into the face of a young girl's corpse. Dr. Hayne is present. Balko reports:

"Reason recently obtained shocking video from another Hayne and West collaboration that may shed light on the question. In 1993, the two conducted an examination on a 23-month-old girl named Haley Oliveaux of West Monroe, Louisiana, who had drowned in her bathtub. The video shows bite marks mysteriously appearing on the toddler's face during the time she was in the custody of Hayne and West. It then shows West repeatedly and methodically pressing and scraping a dental mold of a man's teeth on the dead girl's skin. Forensic scientists who have viewed the footage say the video reveals not only medical malpractice, but criminal evidence tampering."

I used to think I was jaded, but I could never have dreamed that even Drs. Hayne and West would so boldly manufacture false evidence -- and record it on video.

For those of you who may think Mayor Melton should be acquitted because he is fighting the drug trade and "the end justifies the means," this video shows why we have to hold Government accountable to follow the law.

For those of you who think that prisoners who claim to be "framed" are delusional or mendacious, this video will make you re-think that attitude.

And for those of you who are still for the death penalty, remember this: false expert testimony could have sent two innocent men to their death. In our name.

It's time to get damn furious about those who misuse the public trust, and to change the criminal justice system to ensure that the all-too-human tendency to cut corners, assume guilt, and rush to judgment is curtailed and controlled by the rule of law.

Memo to our next United States Attorney: In Illinois, they indicted detectives who manufactured evidence in homicide cases.
